1. Introduction
1.1 These Terms and Conditions (“Terms”) govern access to and participation in the initiatives, programs, projects, platforms, research activities, and services operated under Crashfree India, an initiative of Reg. Vision Zero Trust (“Crashfree India”, “we”, “us”, or “our”). By accessing, participating in, contributing to, or otherwise engaging with Crashfree India in any manner—including through research activities, events, digital platforms, surveys, collaborations, or partnerships—individuals and entities (“Users”, “Participants”, or “Stakeholders”) agree to be bound by these Terms.
1.2 Crashfree India is a public interest, non-profit initiative focused on improving road safety outcomes in India through research, policy advocacy, stakeholder engagement, and on-ground interventions. Its activities include, but are not limited to, conducting research studies, developing policy recommendations, enabling community participation, supporting victim-related initiatives, and collaborating with government bodies, institutions, and civil society organisations.
1.3 Participation in any activity or initiative of Crashfree India is voluntary in nature and does not create any legal right, entitlement, employment relationship, partnership, or claim against Crashfree India or Reg. Vision Zero Trust. All programs and initiatives are undertaken on a best-effort basis and remain subject to operational, legal, and funding considerations.
2. Definitions & Interpretation
2.1 Definitions
For the purposes of these Terms, the following terms shall have the meanings assigned to them below, unless the context otherwise requires:
- 2.1.1 “Participant” means any individual who engages with Crashfree India in any capacity, including but not limited to research participants, survey respondents, crash victims or legal heirs, volunteers, interns, subject matter experts, community members, or users of any platform or initiative.
- 2.1.2 “Program” / “Initiative” means any research study, project, campaign, pilot, platform, activity, or engagement undertaken, operated, or facilitated by Crashfree India, whether ongoing, periodic, or one-time in nature.
- 2.1.3 “Research Data” means any data, information, responses, inputs, or materials collected, generated, or processed in connection with research activities, including surveys, interviews, field assessments, stakeholder consultations, and analytical outputs.
- 2.1.4 “Personal Data” shall have the meaning assigned to it under the Privacy Policy and applicable law, and includes any data that relates to an identifiable individual.
- 2.1.5 “Platform” means any website, mobile application, reporting tool, dashboard, portal, or digital interface operated, managed, or made available by Crashfree India for the purposes of its initiatives or activities.
- 2.1.6 “User” means any individual or entity accessing, browsing, or using any Platform or engaging with Crashfree India in any manner, whether or not registered.
- 2.1.7 “Stakeholder” means any individual or entity interacting or collaborating with Crashfree India, including government authorities, institutions, partners, experts, consultants, or community representatives.
- 2.1.8 “Content” means any data, text, information, images, audio, video, documents, or other material submitted, shared, or made available by Participants or Users in connection with any Program, Platform, or Initiative.
- 2.1.9 “Terms” means these Terms and Conditions, as amended from time to time.
- 2.1.10 “Privacy Policy” means the Privacy Policy published by Crashfree India, which governs the collection, processing, storage, and use of personal data.
2.2 Interpretation
Unless the context otherwise requires:
- 2.2.1 words importing the singular shall include the plural and vice versa;
- 2.2.2 references to a “person” shall include individuals, partnerships, companies, trusts, institutions, and other legal entities;
- 2.2.3 the words “including” and “includes” shall be construed as “including without limitation”;
- 2.2.4 headings are for convenience only and shall not affect interpretation;
- 2.2.5 references to any law or statute shall include any amendments, modifications, or re-enactments thereof;
- 2.2.6 any reference to “writing” or “written” shall include electronic communication, including acceptance through digital means such as clicking “I agree” or submitting forms online;
- 2.2.7 the use of the words “shall” or “must” indicates an obligation, and “may” indicates discretion;
- 2.2.8 in the event of any ambiguity, Crashfree India’s reasonable interpretation shall prevail, to the extent permitted under applicable law.
3. Nature of Initiative
3.1 Crashfree India is a research-driven, policy-oriented, and public interest initiative focused on improving road safety outcomes in India through systemic reform, stakeholder collaboration, data-driven insights, and on-ground interventions.
3.2 The scope of Crashfree India’s activities includes, but is not limited to:
- 3.2.1 conducting research studies, surveys, and field assessments;
- 3.2.2 developing policy recommendations and analytical outputs;
- 3.2.3 engaging with government authorities, institutions, and civil society;
- 3.2.4 operating programs, fellowships, competitions, and community initiatives;
- 3.2.5 building platforms and tools to support road safety awareness and reporting;
- 3.2.6 facilitating collaborations, pilots, and implementation support initiatives.
3.3 All programs, initiatives, platforms, and outputs of Crashfree India are:
- 3.3.1 discretionary in nature and undertaken on a best-effort basis;
- 3.3.2 subject to modification, suspension, or discontinuation at any time, without prior notice;
- 3.3.3 dependent on factors including availability of funding, partnerships, regulatory environment, and operational feasibility.
3.4 Participation in any program, fellowship, competition, or initiative:
- 3.4.1 is voluntary and subject to eligibility criteria, selection processes, and specific terms applicable to such program;
- 3.4.2 does not guarantee selection, continuation, or participation in future initiatives;
- 3.4.3 does not create any entitlement to financial compensation, honorarium, or reimbursement, unless expressly agreed in writing;
- 3.4.4 does not guarantee implementation, adoption, or impact of any research findings, recommendations, or outputs;
- 3.4.5 may be subject to additional program-specific guidelines, requirements, or conditions, which Participants agree to comply with.
3.5 Crashfree India reserves the right, at its sole discretion, to:
- 3.5.1 determine the structure, scope, eligibility, and execution of any initiative;
- 3.5.2 accept, reject, or discontinue participation of any individual or entity;
- 3.5.3 modify or update program requirements, timelines, or deliverables;
- 3.5.4 introduce new initiatives or withdraw existing ones.
3.6 Participation in Crashfree India’s activities does not create any employment, partnership, agency, or fiduciary relationship with Crashfree India or Reg. Vision Zero Trust.
4. Eligibility, Participation and Use of Platform
4.1 Eligibility for participation in any initiative, program, platform, or activity of Crashfree India shall be determined solely by Crashfree India at its discretion. Participants may include, without limitation, researchers, students, volunteers, subject matter experts, stakeholders, government or institutional representatives, community members, and respondents engaging with Crashfree India in any capacity.
4.2 Participation in any initiative is voluntary, unless otherwise governed by a separate written agreement. Crashfree India reserves the right, at any time and without prior notice, to determine, modify, or impose eligibility criteria, participation requirements, or selection processes, and to accept, reject, suspend, or discontinue participation of any individual or entity, without assigning any reasons and without incurring any liability.
4.3 Access to and use of Crashfree India’s website, platforms, and digital tools (collectively, the “Platform”) is permitted solely for lawful purposes and in connection with its objectives, including accessing information, participating in programs or initiatives, contributing to research activities, making voluntary contributions or donations, and sharing content for educational or non-commercial purposes.
4.4 Users agree to use the Platform in a responsible and lawful manner and shall not:
- 4.4.1 use the Platform for any unlawful, fraudulent, or unauthorised purpose;
- 4.4.2 interfere with, disrupt, or compromise the integrity, security, or functionality of the Platform or related systems;
- 4.4.3 attempt to gain unauthorised access to any portion of the Platform, data, or systems;
- 4.4.4 upload, transmit, or distribute any malicious code, harmful content, or material that may adversely affect the Platform or other users;
- 4.4.5 violate any applicable laws, regulations, or third-party rights in connection with use of the Platform.
4.5 Crashfree India reserves the right to monitor usage of the Platform to the extent permitted under applicable law and to restrict, suspend, or terminate access in the event of any actual or suspected misuse, breach of these Terms, or conduct that may adversely affect the Platform, its users, or its objectives.
4.6 Use of the Platform does not create any right, entitlement, or relationship of any nature with Crashfree India, and all access and participation remain subject to these Terms and applicable policies.
5. Data Collection and Use
5.1 Participants acknowledge and agree that, in the course of engaging with Crashfree India, data may be collected, received, or generated through various means, including surveys, interviews, field interactions, digital platforms, communications, or participation in programs and initiatives. Such data may include personal, professional, demographic, financial, or contextual information, depending on the nature of the engagement.
5.2 All data collected shall be processed in accordance with the applicable Privacy Policy and for purposes consistent with Crashfree India’s objectives, including research, policy development, program implementation, stakeholder engagement, and operational requirements. Participation in certain activities may involve audio, video, or other forms of recording, where relevant to the nature of the initiative.
5.3 Participants represent and warrant that:
- 5.3.1 the information provided by them is true, accurate, and not misleading; and
- 5.3.2 they have the necessary authority, consent, or legal basis to share any information, including where such information relates to third parties.
5.4 Crashfree India shall be entitled to rely on the information provided without any obligation to independently verify the same in all cases.
6. Research and Outputs
6.1 Crashfree India may utilise data collected through its initiatives to generate research reports, policy recommendations, analytical outputs, publications, tools, platforms, or other materials intended to support public interest objectives.
6.2 Such outputs may be based on aggregated, anonymised, or otherwise processed data, and may be disseminated through reports, publications, digital platforms, or stakeholder engagements. Participants acknowledge that:
- 6.2.1 research outputs represent analytical interpretations and may not reflect the views, opinions, or experiences of any individual participant;
- 6.2.2 outputs may be used, adapted, or referenced for public interest purposes, including policy advocacy, awareness, and institutional engagement;
- 6.2.3 participation does not confer any ownership, intellectual property rights, or entitlement in respect of such outputs, unless expressly agreed in writing.
6.3 Crashfree India shall have the right to use, reproduce, publish, and disseminate such outputs in furtherance of its objectives.
7. Payments, Honorariums and Reimbursements
7.1 In certain cases, Crashfree India may, at its sole discretion, provide payments, stipends, honorariums, or reimbursements in connection with participation in specific programs, research activities, or engagements.
7.2 Any such payments shall be subject to:
- 7.2.1 submission of complete, accurate, and verifiable documentation, including identification and banking details;
- 7.2.2 compliance with applicable program requirements, policies, and timelines;
- 7.2.3 internal approvals and verification processes.
7.3 Crashfree India reserves the right to determine the eligibility, amount, mode, timing, and conditions of any such payments, and may modify, withhold, defer, or discontinue payments at its discretion.
7.4 Reimbursement claims, where permitted, shall be processed subject to submission of valid supporting documents and may be accepted, limited, or rejected based on internal criteria. Crashfree India shall not be responsible for delays, failures, or discrepancies arising from incomplete documentation, incorrect information provided by Participants, delays attributable to financial institutions or third-party service providers, or any other factors beyond its reasonable control.
8. Third-Party Data and Government Data
8.1 Crashfree India may collect, access, or rely upon data obtained from third-party sources, including government authorities, law enforcement agencies, public records, institutional datasets, stakeholders, or other lawful sources. Such data may include, without limitation, FIR records, enforcement data, RTI responses, or publicly available information. Participants acknowledge that:
- 8.1.1 such data may be subject to limitations inherent to its source, including variations in accuracy, completeness, consistency, or timeliness;
- 8.1.2 Crashfree India may not independently verify all third-party or publicly sourced data;
- 8.1.3 any research outputs, analyses, or insights generated are dependent on the quality and reliability of the underlying data.
8.2 Crashfree India processes such data for legitimate purposes including research, analysis, and public interest initiatives, and does not provide any assurance or guarantee as to the completeness, accuracy, or reliability of such data.
9. Intellectual Property
9.1 All rights, title, and interest in and to all materials, content, research outputs, reports, publications, datasets, methodologies, frameworks, tools, platforms, software, designs, and other works developed, created, or made available by Crashfree India (collectively, the “Materials”) shall vest solely with Crashfree India or its licensors, unless expressly stated otherwise.
9.2 Participants acknowledge and agree that:
- 9.2.1 they shall not reproduce, modify, distribute, publish, transmit, display, perform, or otherwise use any Materials for commercial or non-commercial purposes without prior written consent of Crashfree India;
- 9.2.2 they shall not claim ownership, authorship, or any proprietary rights over any Materials, outputs, or insights generated by Crashfree India;
- 9.2.3 any access to or use of such Materials is limited, non-exclusive, non-transferable, and solely for purposes permitted under these Terms;
- 9.2.4 they shall not misuse, misrepresent, or selectively present any data, findings, or insights in a manner that is misleading or inconsistent with their intended context.
9.3 To the extent Participants contribute any data, content, inputs, feedback, or materials (“Contributions”) as part of their engagement, they grant Crashfree India a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, adapt, publish, and disseminate such Contributions for purposes including research, reporting, advocacy, publications, and awareness initiatives, subject to applicable law and the Privacy Policy.
9.4 Crashfree India may use participant names, affiliations, and non-sensitive Contributions for reporting, publications, impact assessment, or communication purposes, provided that sensitive personal data is not disclosed except in accordance with applicable law.
9.5 Nothing in these Terms shall be construed as transferring or assigning any intellectual property rights from Crashfree India to any Participant, except where expressly agreed in writing.
10. Confidentiality and Publicity
10.1 Participants acknowledge that, in the course of their engagement with Crashfree India, they may have access to certain information that is confidential in nature, including but not limited to internal processes, methodologies, unpublished research, data, communications, or materials not in the public domain (“Confidential Information”).
10.2 Participants agree that they shall:
- 10.2.1 not disclose, publish, or share any Confidential Information with any third party without prior written consent of Crashfree India;
- 10.2.2 use such information solely for the purpose of their engagement with Crashfree India;
- 10.2.3 take reasonable care to prevent unauthorised access, use, or disclosure of such information.
10.3 This obligation shall not apply to information that is publicly available without breach of these Terms, or where disclosure is required under applicable law, subject to prior notice to Crashfree India where feasible.
10.4 Crashfree India may, in connection with its initiatives, use and publish certain non-sensitive information relating to Participants, including names, affiliations, and general contributions, for purposes such as reporting, publications, impact assessment, advocacy, fundraising, and communication activities.
10.5 Crashfree India may also capture and use photographs, video recordings, testimonials, or other media in connection with its programs, events, and initiatives. Where required under applicable law or appropriate in the circumstances, consent shall be obtained prior to the use of identifiable media.
10.6 Any such use shall be undertaken in a manner consistent with applicable law, the Privacy Policy, and the nature of the engagement, and shall not involve disclosure of sensitive personal data except as permitted.
11. Fraud, Misconduct and Disqualification
11.1 Crashfree India reserves the right, at its sole discretion, to take appropriate action, including rejection or termination of participation, withholding of payments, recovery of amounts disbursed (where applicable), and restriction or permanent disqualification from current or future initiatives, in the event of any actual or suspected fraud, misconduct, or non-compliance.
11.2 Such action may be taken in circumstances including, without limitation, where a Participant:
- 11.2.1 provides false, inaccurate, misleading, or incomplete information or documentation;
- 11.2.2 misuses funds, reimbursements, data, or resources made available through any initiative;
- 11.2.3 breaches these Terms, any applicable program-specific conditions, or the Privacy Policy;
- 11.2.4 fails to comply with documentation, reporting, verification, or other operational requirements;
- 11.2.5 engages in conduct that may harm the integrity, objectives, reputation, or functioning of Crashfree India or its initiatives.
11.3 Where amounts have been disbursed on the basis of incorrect information, misrepresentation, or breach, Crashfree India may require repayment, adjust recoverable amounts against any pending or future payments, and take such additional steps as may be necessary to protect its interests.
11.4 All decisions taken by Crashfree India under this clause shall be final, binding, and non-appealable, and no reasons or explanations shall be required to be provided.
12. No Warranty and No Reliance
12.1 All initiatives, programs, platforms, tools, research outputs, and related services of Crashfree India are provided on a best-effort, discretionary, and public interest basis.
12.2 Crashfree India does not make any representation, warranty, or assurance, express or implied, regarding:
- 12.2.1 the accuracy, completeness, reliability, or suitability of any data, report, publication, recommendation, or output;
- 12.2.2 the implementation, adoption, or impact of any recommendation, proposal, or intervention;
- 12.2.3 the continuity, availability, timing, or funding of any initiative, platform, or engagement;
- 12.2.4 the availability of honorariums, reimbursements, or financial support under any program;
- 12.2.5 any academic, professional, financial, legal, or personal outcomes resulting from participation in or reliance on any initiative.
12.3 Participants acknowledge and agree that they participate voluntarily and shall not rely on Crashfree India for any guaranteed result, entitlement, benefit, or outcome of any kind. To the extent permitted under applicable law, all information and outputs are provided “as is” and “as available,” without any warranty of any nature.
13. Limitation of Liability
13.1 To the fullest extent permitted under applicable law, Crashfree India, Reg. Vision Zero Trust, and their respective trustees, officers, employees, representatives, partners, and agents shall not be liable for any loss, damage, cost, or consequence arising out of or in connection with participation in, access to, or use of any initiative, program, platform, output, or engagement under Crashfree India.
13.2 Without limiting the generality of the foregoing, Crashfree India shall not be liable for:
- 13.2.1 non-selection, rejection, suspension, or termination of participation in any program or initiative;
- 13.2.2 delays, modifications, interruptions, or discontinuation of any initiative, platform, activity, or engagement;
- 13.2.3 reliance placed by any person on research outputs, recommendations, reports, data, or other materials generated by Crashfree India;
- 13.2.4 inaccuracies, omissions, inconsistencies, or delays in third-party, public, or government-sourced data;
- 13.2.5 acts, omissions, failures, or delays of third parties, including service providers, institutions, partners, payment intermediaries, or public authorities;
- 13.2.6 system failures, technical issues, cyber incidents, network disruptions, or events beyond Crashfree India’s reasonable control.
13.3 To the extent permitted under applicable law, Crashfree India shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of opportunity, loss of reputation, loss of data, or loss of expected benefits, even if advised of the possibility of such damages.
13.4 Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is prohibited under applicable law.
14. Indemnity
14.1 Each Participant agrees to indemnify, defend, and hold harmless Crashfree India, Reg. Vision Zero Trust, and their respective trustees, officers, employees, representatives, partners, and agents (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable legal fees and expenses) arising out of or in connection with:
- 14.1.1 any breach of these Terms, the Privacy Policy, or any applicable program-specific terms;
- 14.1.2 submission of false, inaccurate, misleading, unauthorised, or unlawful data, information, or documentation;
- 14.1.3 misuse of any data, platform, tool, report, or output provided or made available by Crashfree India;
- 14.1.4 any unlawful act, omission, negligence, or misconduct by the Participant;
- 14.1.5 infringement of any third-party rights, including intellectual property, confidentiality, privacy, or data protection rights, arising from the Participant’s actions or submissions.
14.2 Crashfree India reserves the right to assume exclusive control of the defence and settlement of any matter subject to indemnification, and the Participant agrees to cooperate fully in such defence. The Participant shall not settle any claim that imposes any obligation or liability on any Indemnified Party without prior written consent of Crashfree India.
14.3 The obligations under this clause shall survive termination of participation, discontinuation of any initiative, and expiry or termination of these Terms.
15. Modification and Termination
15.1 Crashfree India reserves the right, at its sole discretion and without prior notice, to modify, amend, update, or replace these Terms at any time. Crashfree India may also change, suspend, restructure, or discontinue any program, initiative, platform, eligibility criteria, process, timeline, or engagement model, in whole or in part, at any time.
15.2 Any such modification or change shall become effective upon publication on the relevant Platform or communication through any official channel of Crashfree India, unless otherwise specified. Continued access to or participation in any initiative after such publication shall constitute acceptance of the revised Terms.
15.3 Crashfree India may, at its discretion, suspend or terminate any Participant’s access to a program or Platform, or discontinue participation, where it determines that such action is necessary for operational, legal, compliance, or policy reasons, or where a breach of these Terms is suspected or established.
16. No Right or Entitlement
16.1 Participation in any initiative, program, platform, fellowship, competition, or activity of Crashfree India is voluntary and discretionary, and does not create any contractual, employment, agency, partnership, fiduciary, or similar relationship between Crashfree India and any Participant.
16.2 Participation does not create any right, entitlement, or claim to:
- 16.2.1 selection or continued participation in any initiative;
- 16.2.2 receipt of any payment, honorarium, reimbursement, or other benefit;
- 16.2.3 renewal, extension, or continuation of any engagement;
- 16.2.4 implementation of any recommendation, proposal, or output.
16.3 All decisions made by Crashfree India in relation to eligibility, participation, continuation, suspension, termination, payments, or any other aspect of engagement shall be final, binding, and non-appealable, and Crashfree India shall not be required to provide reasons or justification for such decisions.
17. Governing Law and Dispute Resolution
17.1 These Terms shall be governed by and construed in accordance with the laws of India.
17.2 Any dispute, controversy, or claim arising out of or in connection with these Terms, or any participation in or engagement with Crashfree India, shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
17.3 The arbitration shall be conducted by a sole arbitrator appointed by Crashfree India. The seat and venue of arbitration shall be New Delhi, India, and the arbitration proceedings shall be conducted in the English language.
17.4 The arbitral award shall be final and binding on the parties. Nothing in this clause shall prevent Crashfree India from seeking interim, injunctive, or other urgent relief from a court of competent jurisdiction.
18. Force Majeure
18.1 Crashfree India shall not be liable for any delay, interruption, suspension, modification, or failure in performance of any obligation or initiative where such delay or failure is caused, directly or indirectly, by events beyond its reasonable control, including but not limited to natural disasters, acts of God, epidemics or pandemics, governmental actions or restrictions, changes in law or regulation, civil disturbances, strikes, system failures, cyber incidents, utility outages, funding disruptions, or withdrawal of support from partners or collaborators. In such circumstances, Crashfree India shall be entitled to defer, suspend, modify, or discontinue any program, platform, activity, payment, or engagement, in whole or in part, without incurring any liability.
19. Miscellaneous
- 19.1 Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be severed to the extent necessary, and the remaining provisions shall continue in full force and effect.
- 19.2 Waiver: Failure or delay by Crashfree India in enforcing any right or provision under these Terms shall not constitute a waiver of such right or provision, nor shall it prevent Crashfree India from enforcing the same at a later time.
- 19.3 Entire Agreement: These Terms, together with the Privacy Policy and any applicable program-specific terms, constitute the entire agreement between Crashfree India and the Participant in relation to the subject matter hereof, and supersede all prior discussions, understandings, or communications, whether written or oral.
