About this initiative
India’s road crash compensation framework is robust on paper but lags at delivery. As per data, there are around 10.46 lakh pending compensation cases nationwide, representing ~₹80,455 crore in pending claims. Crashfree India’s research documents claim rates as low as ~5% of eligible crashes (in case of Hit and Run) and systemic bottlenecks across awareness, timeliness, legal efficiency, adequacy, and equity for MACT cases.
These problems are not theory — they emerge from 50+ expert consultations (judiciary, claimant advocates, insurers, police, legal aid, district administration & MoRTH), access to institutional data & RTIs, field visits, pilot surveys with 120+ victims and families, and hospital helpdesks that reveal where victims first encounter information shortfalls and procedural collapse.
This study therefore aims to diagnose, with victim-centred evidence, why statutory entitlements rarely translate into actual compensation.
The intended result is an actionable blueprint: prioritised, evidence-backed reforms and scalable operational models that shorten timelines, prevent exploitation, improve documentation flows, expand legal aid visibility, and increase the proportion of eligible victims who actually receive timely, adequate compensation.

Under the Motor Vehicles Act, crash victims and their families are entitled to financial support.
Up to ₹1.5 Lakh
Crash victims are entitled to cashless treatment at designated hospitals for the first 7 days after an accident.

If the driver fled the scene, victims or families can still claim compensation under the government's hit-and-run scheme — ₹2,00,000 in case of death and ₹50,000 for grievous injury.
